How North Carolina Courts Decide Child Custody
Under North Carolina General Statute § 50-13.2(a), a custody order must promote the child’s interest and welfare. The law doesn’t presume that either parent will better serve that standard. Instead, the court considers the circumstances of the individual child and family.
Legal custody concerns authority to make decisions for a child, while physical custody concerns where the child resides. Either form may be sole or shared. We negotiate both types of custody and develop parenting plans for civilian and military parents.
A custody arrangement may address:
- Decision-making authority: How parents handle choices involving the child.
- Residential arrangements: Where the child lives during the regular schedule.
- Parenting time: How weekdays, weekends, holidays, and other periods are allocated.
A North Carolina court must consider all relevant factors, including domestic violence between the parties, child safety, and either party’s safety from domestic violence by the other party. The court must also consider joint custody when either parent requests it, but joint custody isn’t automatically presumed.
The Custody Process in Moore County
During a consultation, a parent can discuss the family’s circumstances, existing orders, and unresolved questions with counsel. Moore County District Court handles domestic relations cases, including child custody disputes involving Carthage families.
North Carolina law requires parents to participate in custody mediation before litigating permanent custody issues. Mediation and direct negotiation can address legal custody, physical custody, and schedules before trial. A negotiated parenting plan may resolve some or all disputed terms without requiring a judge to decide them.
If the parties can’t reach an agreement, we present the dispute in court. We prepare each case as though it may proceed to trial, developing the details needed for negotiations and any required hearing. That preparation is especially important when the parties disagree about safety, decision-making, or the practical terms of a parenting schedule.
Modifying or Enforcing a Custody Order
An existing order may require attention when circumstances affecting the child have changed or when a parent isn’t following its terms. We petition for emergency or long-term modifications and file post-judgment enforcement actions.
Under North Carolina General Statute § 50-13.7(a), the parent requesting a modification must show a change in circumstances that justifies modifying the order. The judge must also find that the requested change serves the child’s best interests. The facts connecting the changed circumstances to the child’s welfare are therefore central to the court’s review.
A judge may consider a child’s custody preference if the child has enough maturity to form an intelligent view. That preference doesn’t control the decision, and the judge isn’t required to follow it. Other evidence relevant to the child’s interests remains part of the analysis.
Enforcement serves a different purpose from modification. It asks the court to address noncompliance with an existing order rather than replace that order with new terms. We assess the order and the conduct at issue before pursuing enforcement.
Custody Arrangements for Military Families
Military service can require a parenting plan to account for deployment, long-distance schedules, relocation, and temporary changes in care. We develop plans for military parents and address deployment-related temporary custody changes, long-distance visitation, and relocation requests involving service members.
In a proceeding involving a service member, past deployment or the possibility of future deployment can’t be the sole basis for determining the child’s best interests. A court may, however, consider a deployment’s significant effect on the child. The analysis depends on the family’s circumstances and the practical impact of military obligations.
A carefully developed plan may address temporary care during deployment and parenting time across long distances. We provide guidance grounded in the issue before the court while accounting for the realities military parents and spouses face.
